Tunisia: Questionnaire Challenges Candidates on Human Rights Issues
October Vote for Constituent Assembly Will Set Nation’s Course 
(Tunis, August 9, 2011) – Candidates running for the Constituent Assembly should make a public commitment to protect human rights, Human Rights Watch said today, in addressing a questionnaire to all of Tunisia’s political parties.
The questionnaire invites all candidates – those running both on party lists and independent lists in the October 23, 2011 election – to state their positions on key human rights issues. These include the need to guarantee gender equality as a matter of law, eliminate criminal penalties for nonviolent speech, strengthen judicial independence, and revise the anti-terrorism law to ensure it does not criminalize speech offenses or trample the right to a fair trial.
“The stakes for human rights are enormous in the election of an assembly that will draft a new constitution and probably adopt critical laws,” said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch. “We hope the responses that parties and candidates give to this questionnaire on human rights issues will help voters make an informed choice on October 23.”
The questionnaire asks candidates to explain their position on 20 questions, including:
 

Will you support legislation to eliminate prison terms in the penal and press codes as a punishment for all nonviolent speech “offenses”?

 
Do you support making changes to Tunisia’s law on personal status? If so, what types of changes do you support?
 

Will you support amendments to the Law on the Magistrature to remove the control that the executive branch and its appointees effectively enjoy in the High Council of the Magistrature over decisions on the promotion and assignment of judges?

 
The Constituent Assembly will draft Tunisia’s next Constitution and set up interim institutions to govern the country until regular parliamentary and presidential elections are held. Human Rights Watch said that these responsibilities give the Constituent Assembly a major opportunity to erect a strong legal framework for consolidating human rights and reversing the legislative assault on human rights and the repressive practices that characterized the presidency of Zine el-Abidine Ben Ali.

In early October, before the elections, Human Rights Watch will publish in Tunisia the responses it receives to its questionnaire.

تونس: استبيان حول قضايا حقوق الإنسان موجه إلى المرشحين لانتخابات المجلس التأسيسي
انتخابات أكتوبر/تشرين الأول سوف تحدد مسار البلاد

9 أغسطس/آب 2011) ـ قالت هيومن رايتس ووتش اليوم في استبيان موجه إلى جميع الأحزاب السياسية التونسية إنه ينبغي على المرشحين لانتخابات المجلس التأسيسي أن يقدموا التزاما علنيا بحماية حقوق الإنسان.

ودعا 
الاستبيان جميع المرشحين لانتخابات أكتوبر/تشرين الأول، المنتمين إلى قائمات حزبية والمستقلين، للتعبير عن وجهات نظرهم حول مسائل جوهرية في حقوق الإنسان مثل الحاجة إلى ضمان المساواة بين الجنسين كمسألة قانونية، والقضاء على تجريم التعبير السلمي، وتعزيز استقلالية القضاء، ومراجعة قانون مكافحة الإرهاب بما يضمن عدم تجريم حرية التعبير وعدم المس بالحق في المحاكمة العادلة.

وقالت سارة ليا ويتسن، المدير التنفيذي لقسم الشرق الأوسط وشمال أفريقيا في هيومن رايتس ووتش: "إن الرهانات المتعلقة بحقوق الإنسان كبيرة جدا في انتخابات المجلس التأسيسي الذي سوف يقوم بصياغة دستور جديد وقد يتبنى قوانين مهمة جدا. ونرجو أن تساعد إجابات الأحزاب والمرشحين على أسئلة الاستبيان والمتعلقة بقضايا حقوق الإنسان، الناخبين في القيام باقتراع مستنير في 23 أكتوبر/تشرين الأول".

ويطلب الاستبيان من المرشحين شرح مواقفهم من خلال 20 سؤالاً نذكر منها:

هل ستدعمون تشريعات للقضاء على عقوبة السجن في القانون الجزائي وقانون الصحافة كعقاب على جميع "جرائم"الخطاب غير العنيف؟

هل تؤيدون إجراء تغييرات على القانون التونسي المتعلق بالأحوال الشخصية؟ إذا كان الأمر كذلك، فما هي أنواع التغييرات التي تدعمونها؟

هل ستدعمون تعديلات على قانون للقضاء لإزالة سيطرة السلطة التنفيذية، ومن تعينهم في المجلس الأعلى للقضاء، على قرارات ترقية وتعيين القضاة؟

وسوف يقوم المجلس التأسيسي بصياغة دستور جديد لتونس وبإنشاء المؤسسات المؤقتة التي سوف تحكم البلاد إلى حين إجراء الانتخابات البرلمانية والرئاسية العادية. وقالت هيومن رايتس ووتش إن هذه المسؤوليات توفر للمجلس التأسيسي فرصة خلق إطار قانوني قوي يدعم حقوق الإنسان ويضع حداً بشكل نهائي للاعتداءات التشريعية والممارسات القمعية التي ميّزت حقبة رئاسة زين العابدين بن علي.
 
وسوف تقوم هيومن رايتس ووتش في مطلع أكتوبر/تشرين الأول بنشر الإجابات التي سوف تتلقاها.

Tunisie : Les candidats mis à l’épreuve par un questionnaire sur les droits humains

Le vote d’octobre pour élire l’Assemblée Constituante fixera le cap pour la nation
(Tunis, le 9 août 2011) – Les candidats à l’élection de l’Assemblée Constituante devraient s’engager publiquement à protéger les droits humains, a déclaré aujourd’hui Human Rights Watch, tout en adressant un questionnaire à tous les partis politiques tunisiens.
Le questionnaire (version anglaise – version arabe) invite tous les candidats se présentant aux élections du 23 octobre 2011 – aussi bien sur les listes des partis que sur les listes indépendantes – à faire connaître leur position sur des thèmes-clés des droits humains. Il s’agit entre autres de la nécessité de garantir l’égalité des genres en l’inscrivant dans la loi, d’éliminer les peines criminelles punissant des actes d’expression non violents, de renforcer l’indépendance de la justice et d’amender la loi antiterroriste pour assurer qu’elle ne criminalise pas les délits d’expression et qu’elle ne bafoue pas le droit à un procès équitable.
« Les enjeux pour les droits humains sont de taille dans l’élection d’une assemblée qui va esquisser une nouvelle constitution et probablement adopter des lois cruciales », a déclaré Sarah Leah Whitson, directrice de la division Moyen-Orient et Afrique du Nord à Human Rights Watch. « Nous espérons que les réponses fournies par les partis et les candidats à ce questionnaire sur le thème des droits humains aidera les électeurs à faire un choix éclairé le 23 octobre. »
 
Le questionnaire demande aux candidats d’expliquer leur position sur 20 questions, dont :
Soutiendrez-vous une législation éliminant du code pénal et du code de la presse les peines de prison comme sanction de tous les « délits » d’expression non violents ?
Soutenez-vous le projet de modifier la loi tunisienne sur le statut personnel ? Si oui, quel type de modifications soutenez-vous ?
Soutiendrez-vous les amendements de la Loi sur la Magistrature visant à éliminer le contrôle qu’exercent en fait le pouvoir exécutif et ses représentants, au sein du Haut Conseil de la Magistrature, sur les décisions de promotion et d’affectation des juges ?
L’Assemblée Constituante proposera une ébauche de la prochaine Constitution tunisienne et mettra en place des institutions provisoires pour gouverner le pays jusqu’à ce que se tiennent de véritables élections législatives et présidentielles. Human Rights Watch a déclaré que ces responsabilités offrent à l’Assemblée Constituante une opportunité capitale d’ériger un cadre légal fort en vue de consolider les droits humains et d’inverser la vapeur après les attaques contre les droits humains faites au nom de la loi et les pratiques répressives qui caractérisaient la présidence de Zine El Abidine Ben Ali.
Début octobre, avant les élections, Human Rights Watch publiera en Tunisie les réponses au questionnaire que l’organisation aura reçues.
